1. The service
BINAI ("the Service") is a content creation and editing app for small businesses, marketers and creators, operated by Binai.it and available at app.binai.it and as an iOS and Android app. With BINAI you can clip long videos into short ones with inserts and subtitles, make product videos, animated videos, images and music, swap a character in a photo or video, edit your work in the editor and run a content check before you publish. The work is done by third-party AI models and by our own processing servers. By creating an account or using the Service, you agree to these Terms.
2. Accounts and eligibility
You must be able to form a binding contract in your jurisdiction to use BINAI. You are responsible for maintaining the security of your account and for all activity that occurs under it.
3. Subscriptions, credits and billing
Paid plans (Solo, Pro, Business, Studio) are monthly subscriptions billed in advance. On the web, payments are processed by our payment processor, Stripe; in the iOS and Android apps, you can also subscribe through the Apple App Store or Google Play, under that store's terms. Each plan includes a monthly amount of credits that resets at the start of each billing period; unused monthly credits do not carry over. Everything you generate or process with AI is paid for in credits, and the features and limits available depend on your plan. The cost shown before you start a job is an estimate: credits are charged for the work actually done, so the final amount can differ. Where we offer one-time credit packs, they are available to subscribers only, are billed once, do not expire, and can be used while you have an active plan. You may cancel a subscription at any time; access continues until the end of the paid period. A subscription bought through the App Store or Google Play is managed and cancelled from that store. Fees are non-refundable except where required by law.
4. Free plan
A Free account lets you sign in, look around and set up projects by hand. The Free plan includes no credits and cannot use features that run on paid AI models, such as generating videos, images, music or clips; those require a paid plan. We may change what the Free plan includes at our discretion.
5. Acceptable use
You agree not to use BINAI to generate content that is illegal, infringing, harmful, deceptive, or that violates the acceptable-use policies of the underlying AI providers. You also agree not to use a real person's face, likeness or voice (for example in a character swap or a cloned voice) without their permission.
6. Sexual and intimate imagery: never allowed
BINAI is not a tool for sexual content. You may not use BINAI to create, edit or request:
- sexual, nude or intimate images, video or audio of a real, identifiable person, whether or not they consented, including "undressing" a photo, putting someone's face on a sexual or nude body, or any other non-consensual intimate imagery (NCII) or sexual deepfake;
- any sexual or sexualised content involving minors, or anyone who appears to be a minor;
- sexually explicit content of any kind.
BINAI checks requests before they run, including the text you write and the photos and videos you give to character swap and image tools, and refuses those that ask for this kind of content. Attempts are logged. We suspend or close accounts that try to create it, remove the content, and report child sexual abuse material to the competent authorities. If you see content made with BINAI that breaks this rule, including content that shows you, write to mail@binai.it and we will act on it as a priority.
7. Reporting content
If you encounter generated content that violates these Terms, you can report it by emailing mail@binai.it. We review reports and may remove content or suspend the account that generated it.
8. AI outputs
Content is generated or edited by third-party AI models, including language, image, video, voice and music models from companies such as Google, Anthropic, OpenAI and others, which we reach through routing and hosting providers. BINAI does not control and cannot guarantee the accuracy, completeness, originality or appropriateness of AI-generated output, including facts, subtitles, translations and the results of the content check. The content check is guidance, not legal advice or a promise that a platform will accept your content. You are responsible for reviewing content before you publish or rely on it. The Service is provided "as is", without warranties of any kind.
9. Video you bring to the Service
Some BINAI features work on a video you point us at by URL or upload: clipping a long video into short ones, generating or translating subtitles, generating dubbed audio, and swapping a character. You are solely responsible for having the right to do this. By submitting a link or a file you confirm that you own the video, that you are licensed to use it in the way you have asked for, or that your use is otherwise permitted by law in your jurisdiction.
This includes the terms of the platform the video is hosted on. YouTube, Twitch, Rumble, Vimeo and others each set their own rules about downloading and reusing content, and those rules apply to you independently of these Terms. BINAI does not and cannot verify who owns a video or what licence covers it, and submitting a link is not a representation by us that the use is permitted.
Subtitles, translations and dubbed audio we generate are derivative of the video you supplied: the rights in the underlying video are unaffected by our processing of it, and the output carries the same restrictions as its source. We do not grant you any rights in anyone else's content.
We remove material on valid notice from a rights holder, and we may suspend accounts that repeatedly submit infringing material. Notices go to mail@binai.it and should identify the work, the URL of the material on our Service, and your contact details and authority to act.
Source video we download from a link to process your request is temporary: it is deleted from our processing servers once the job finishes or fails. A video you upload is stored with your project so you can work on it again. What is kept is what you uploaded and what you asked us to produce, such as the clips, subtitles or audio in your projects, which you can delete at any time.
10. Termination and account deletion
We may suspend or terminate your access to the Service for breach of these Terms. You may stop using the Service and delete your account, and all associated projects and data, at any time from Account settings → Delete account in the app. Deletion is permanent and cannot be undone. Deleting your account cancels a subscription paid through Stripe. If you can no longer access the app, email mail@binai.it from the address on your account and we will delete it for you, normally within 30 days. Deleting your BINAI account does not cancel a Google Play or App Store subscription: cancel those separately from the respective store.
11. Governing law
These Terms are governed by the laws of Italy. Any dispute arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the competent courts of Italy, without prejudice to any mandatory consumer-protection rights you may have in your country of residence.
